The Petitioner seeks to place reliance upon the averments made in his written statement or upon certain documents to contend that proceedings under the Maharashtra Rent Control Act, 1999 are not maintainable. At the stage of deciding an application under Order VII Rule 11(d) of the CPC, it is not permissible to advert to the defence of the Petitioner. The defence of the Petitioner, will no doubt be taken into consideration at the appropriate stage by the Trial Court. Accordingly, this review petition is dismissed. There shall be no order as to costs.
