Heard Shri Aniket Vagal, the learned counsel for the applicant. The appeal filed by the applicant challenging his conviction and the sentences imposed upon him has already been admitted. By the present application, the applicant prays that substantive sentences imposed upon him be suspended, and that, he be released on bail.

Shri Aniket Vagal, the learned counsel for the applicant, submits that the applicant has already undergone a sentence of more than four years. He submits that since the appeal is not being heard expeditiously, the applicant be released on bail by suspending the substantive sentences imposed upon him.
I find that the maximum sentence imposed upon the applicant is of Rigorous Imprisonment for 10 years. I have glanced through the evidence and the relevant part of the impugned judgment. Considering the nature of evidence that was adduced against the applicant and the nature of the offence, I am not inclined to suspend the sentences imposed upon the applicant. However, considering the period spent in custody by the applicant after his conviction, the appeal needs to be decided expeditiously. The application is rejected.
However, the hearing of the appeal is ordered to be expedited.

I am informed that the co-accused, who was convicted on the same trial, has also filed an appeal. The learned counsel for the applicant submits that he would give the number of that appeal.
