The petitioner during the course of hearing of this petition has produced prospective purchaser before this Court alongwith petitioner, with an offer to purchase the property "Office No. 601, 6th Floor, Meet Galaxy Off. L.B.S. Road, Behind Tip Top Plaza, Opp. Raheja Garden, Near Teen Hath Naka, Thane (W) " and submits that he is ready to purchase the said property for 1.20 Crore.

2 43.8039.19 wp.doc Since this Court is not inclined to go into all these issues, as the same is brought before this Court at a premature stage, the learned counsel for the petitioner made a motion for withdrawal of the petition.

Petition stands disposed of as withdrawn with liberty to the petitioner to make his offer before Recovery Officer. This Court expects the Recovery Officer to consider the said offer while selling the property in question referred above so as to satisfy debt against the petitioner.
