Heard learned counsel for the applicant and learned APP for the State.

This is an application for bail by the applicant-Narayan Singh Rajawat in connection with C.R. No.I-128 of 2018 registered with Mahatma Phule Chowk Police Station for the offence punishable under Section 307 of the Indian Penal Code, 1860 (hereafter "the IPC", fort short). 3.
It is the case of the prosecution that the applicant who is 21 years of age assaulted the complainant with a knife on his neck. The applicant suffered grievous injuries. No doubt the accusation is serious. Considering the offence alleged against the applicant is under Section 307 of the IPC and 1/3
that the applicant is in custody since 16/03/2018 for a period of almost 4 years and 10 months, the applicant can be enlarged on bail due to his long incarceration as an under-trial prisoner. Though, I am informed that the charge has been framed but as many as 15 witnesses are to be examined and the trial likely to take a long time. There are no criminal antecedents reported against the applicant. The charge-sheet has been filed and the investigation is complete.

Considering the nature of the accusations and the fact that the applicant is in custody almost for 4 years and 10 months as an under-trial prisoner, the applicant is enlarged on bail.

Hence, the following order :-
ORDER
(a) Application is allowed.
(b) Applicant-Narayan Singh Rajawat shall be released on bail in connection with C.R. No.I-128 of 2018 registered with Mahatma Phule Chowk Police Station, on his furnishing P.R. Bond of Rs.25,000/- with one or more sureties in the like amount. 2/3
(c) The applicant is permitted to furnish cash bail surety in the sum of Rs. 25,000/- for a period of 6 weeks in lieu of surety.
(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence. (e) The applicant shall report to the concerned police station once in a month i.e. on first Monday of every month between 11.00 a.m. and 1.00 p.m.
(f) On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change.

The Bail Application is disposed of.
