Heard the learned counsel for the applicant and perused the record of investigation.

This is an application under Section 438 of the Criminal Procedure Code for pre-arrest bail in CR No. 213 of 2018 dated 21/6/2018 registered with Vileparle Police Station, Mumbai under Sections 406, 420 read with Section 34 of the Indian Penal Code. 3.

The first information report is lodged by Shri Sachin Patil. It is alleged that accused no.1 Nrupathy Mane accepted a sum of Rs.6,35,486/- from the informant and his friends for package tour to Singapore, but neither gave them visa nor arranged for their said travel and defalcated the amount paid to him. 1/2

The record of investigation indicates that the principal accused Nrupathy Mane has been arrested by the police and till date he is in judicial custody. The bank account of the said accused has been freezed by the police. The applicant was an employee of the said Nrupathy Mane and under the dictates of the said principal accused, she on few occasions accompanied him to the place of the informant and had also given phone calls to the informant and his friends. Apart from the said fact, no other overtact is attributed to her. 5.

In view thereof, the applicant is entitled to be protected by pre-arrest bail.

Hence, the following order:- a) In the event of arrest in CR No. 213 of 2018 dated 21/6/2018 registered with Vileparle Police Station, Mumbai, the Applicant shall be released on bail on her furnishing PR bond of Rs.15,000/- with one or two solvent local sureties in the like amount. b) The Applicant shall not tamper with the evidence and/or pressurize the prosecution witnesses.
