The Learned Counsel appearing on behalf of the Petitioner Mr. R. V. Paranjape makes a statement that the Petitioner has no objection if the Respondent withdraws the amount of Rs.24,840/- which is lying in deposit with the office of the Deputy Commissioner of Labour Mumbai. However, he submits that without going into the merits of the impugned orders, the impugned orders may be set aside.

The Learned Counsel appearing on behalf of the Respondent Mr. Bulbule on instructions of the Respondent who is personally present in court has no objection to the said course of action being followed. The impugned orders i.e. the order dated 5-1-2006 condoning the delay of 7 years in filing the application before the Controlling Authority, the mmj

wp-10833-16-(9) order dated 8-6-2009 passed by the Controlling Authority determining the liability of the Petitioner as being Rs.12,420/- and directing payment of interest @ 12% as also the order dated 23-5-2016 passed by the Appellate Authority under the payment of Gratuity Act are quashed and set aside in view of the consensus reached between the parties. The Respondent would accordingly be entitled to withdraw the amount of Rs.24,840/- along with interest if any which has accrued on the said amount. The Petition to accordingly stand disposed of.
