The learned counsel for the applicant submits that during the pendency of the present application, the investigation is completed and charge-sheet is filed. Hence, the learned counsel, upon instructions, seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice with further liberty to file an application under Section 439 of Cr.P.C. before the appropriate Court. The learned Sessions Court shall consider the application on its own merits without being influenced by the withdrawal of this application.

Application stands dismissed as withdrawn with liberty as prayed.
