Though this appeal has been added to the Final Hearing Board, while dealing with the appeal filed by a coaccused in the same sessions case, it was noticed that the conviction has been recorded by an Assistant Sessions Judge, and that, the sentence of imprisonment is for a period of 7 years and not more than that.

5-APPEAL-1134-2012.doc As such, the appeal should lie before the Court of Sessions in accordance with Clause (c) of sub-section (3) of Section 374 of Code of Criminal Procedure.
Registry to do the needful forthwith.
The Court of Sessions shall be directed to hear the appeal expeditiously and preferably within a period of three months from the date of receipt of record and proceedings by it. This order be communicated to the learned counsel for the appellant, who is not present today.
