Mr. Jadhav, the learned advocate for the appellant seeks to withdraw the appeal stating that the appellant desires to file a substantive suit for declaration of his rights to the suit property. The appeal is allowed to be withdrawn. 2.

Mr. Jadhav also requests for extension of the ad-interim reliefs for a reasonable period as to enable the appellant to file the substantive suit. The interim reliefs operative in the suit is extended for a period of eight weeks from today. Mr. Jadhav on instructions from appellant, who is present in the Court, makes a statement that the appellant will not put up any kind of enclosure around part of the suit property which is an open space.
