Arbitration Petition (L) No.1194 of 2018 is not on board. Upon mentioning, the same is taken on board.

Perused the order dated 7 th December, 2018 passed in Arbitration Petition No.94 of 2018. Pursuant thereto, Mr. Farhan Dubash, Advocate has submitted his disclosure under Section 11(8) read with Section 12(1) of the Arbitration and Conciliation Act, 1996 as amended by the Arbitration and Conciliation (Amendment) Act, 2015 (Act No.3 of 2016) (the Act). The disclosure filed by Mr. Farhan Dubash,

kpd 2 / 2 925-ARP-94-2018.doc Advocate is taken on record. Both the parties have gone through the said disclosure and have no objection to the said disclosure. In view thereof, the following order is passed :

i.

The disputes between the parties arising out of the Partnership Deed dated 23 rd April, 1981 are referred to the sole Arbitrator Mr. Farhan Dubash, Advocate. ii.

The above Arbitration Petition (L) No.1194 of 2018 under Section 9 of the Act shall be treated as a Petition under Section 17 of the Act and decided by the Learned Arbitrator within a period of eight weeks from the date of first meeting held by the Arbitrator with the parties and their Advocates. iii.

Parties and/or their Advocates shall appear before the Learned Arbitrator in his Chamber on 7 th January, 2019 at 5.00 p.m. and obtain necessary directions.

iv.

The Learned Arbitrator shall endeavour to pass his final Award within a period of six months from today. The Learned Arbitrator shall not grant adjournment/s to the parties unless absolutely necessary. v.

The venue of arbitration shall be at Mumbai.

vi.

The cost of arbitration shall initially be borne by the parties equally. vii.

All contentions of the parties are kept open. viii.

In view of this order, both the above Arbitration Petitions stand disposed off.
