On reference being made to this Court by the Family Court, Mumbai the above contempt proceedings were initiated against the Respondent who has not complied with the Consent Terms in the matter of payment of maintenance to the original Applicant i.e. his wife Anisha Abhijeet Parulekar.
In the above contempt proceedings a notice came to be issued to the Respondent Abhijeet Subhash Parulekar and in view of the fact that the Respondent did not appear, a bailable warrant in the sum of Rs.10,000/- came to be issued by a learned Single Judge of this Court by order dated 29/01/2016. The bailable warrant has returned un-executed as the Respondent Abhijeet Subhash Parulekar has expired on 02/01/2015 and his death certificate recording the said date as the date of his death has been forwarded to this Court by the Naupada Police Station, Thane who had gone to lgc
cp-362.13 execute the warrant. In view of the death of the Respondent, the above contempt proceedings have turned infructuous and are disposed of as such. [R.M.SAVANT, J] lgc
