There is delay of 181 days in filing the appeal. This civil application is already abated as against the respondent no.1 who was the original claimant. The name of the respondent no.1 is already deleted. No steps are taken by the appellant for setting aside the abatement order passed by the learned Registrar dated 25th April 2016 against the original claimant. Nothing survive in the first appeal itself. Both the civil applications as well as the First Appeal are accordingly dismissed. No order as to costs.
