This Contempt Petition is filed against the respondents, as they have allegedly committed breach of the order dated 28th February, 2005 passed by the Division Bench of this Court granting interim relief in favour of the petitioner that the respondents shall not create any third party interest in the suit property till the final disposal of the Appeal. 2.

The learned counsel for petitioner submitted that during the pendency of the Civil Application and First Appeal, respondent nos. 1 to 5, who wanted to start a hotel along with respondent no. 7 as a joint venture, have dropped the said project. The petitioner thereafter moved an application for appointment of the Court receiver before this Court, however, interregnum due to enhancement of pecuniary jurisdiction of the 1 / 2

15.CP197_2015.doc District Court, the First Appeal was transferred to District Court by the order of this Court dated 24th November, 2015. The learned counsel submitted that as the Appeal is transferred to District Court, the Application for Court receiver will be heard and decided there. 3.

In view of this subsequent development, nothing survives in the Petition. Hence, the Contempt Petition is disposed of. (MRIDULA BHATKAR, J.) 2 / 2
