The applicants are seeking regular bail in Crime No. I-362 of 2015 for the offences punishable under Sections 302, 201, 364, 367 read with Section 34 Indian Penal Code and Sections 37(1) and 135 of the Bombay Police Act.

The investigation in the matter is complete. Chargesheet is already filed.

The only role that could be gathered from the chargesheet is against the present applicants are that, they have helped the other co-accused in destroying the evidence. The main accused is claimed to have committed the offence of murder punishable under Section 302 and in such an eventuality if Section 201 is considered, the maximum punishment that could be awarded to the applicants is of 7 years.

There are no criminal antecedents. Hence, it will be appropriate to allow the application.

5).

The Bail Application is allowed. The applicants be released on P.R. Bond of Rs.50,000/- (Rs. Fifty Thousand only) each with one or two sureties in the like amount. 6).

The applicants to remain present before the Investigation Officer as and when called.

7).

The applicants shall not tamper with the evidence and/or influence the witnesses in any manner whatsoever. (N.W. SAMBRE, J)
