CIVIL APPELLATE JURISDICTION ARBITRATION APPEAL NO. 11 OF 2017 Sunil Mangalchand Sakhala and Anr.

...

Appellants vs.

The Nashik Merchants Co-op Bank Ltd. and Ors. ...

Respondents Mr. Sandeep Waghmare for Appellants.

Mr. Nikhil Pujari for Respondent no. 1.

Mr. Rajesh Patil for Respondent no. 2.

CORAM : A.K. MENON, J.

DATED : 20th MARCH, 2020 P.C.

1.

The appeal is listed on account of the inability of the regular Court to take up the matter. Learned counsel for the parties have arrived at a settlement and they seek to file consent terms as a result of which award will stand satisfied. 2.

Signatories are present in person and they are identified by their respective Advocates. The payments due under the consent terms have already been made today and the award dated 29th September, 2007 forming subject matter of the consent terms stands satisfied. In view thereof I pass the following order : (i) There will be an order in terms of the consent terms which is taken on record and marked "X" for identification.

(ii) The amount to be withdrawn by the appellants shall be paid over along with accrued interest.

(iii) Arbitration Appeal disposed of in the above terms. (A.K. MENON, J.) 1/1
