Versus

Applicant is seeking bail in Crime No.282 of 2020 registered with Jath Police Station, Sangli for the offence punishable under Sections 302 r/w 34 of IPC.

Case of the prosecution is, daughter of accused No.1 was in love with deceased Dhanaji. It is claimed that even after reprimand, Dhanaji continued to harass the victim and as such, applicant along with other accused persons committed murder of Dhanaji. The statement of complainant, so also one Sunil Kharat is relied on.

This Court vide order dated 6th October, 2021 passed in Criminal Bail Application No.3182 of 2021 and order dated 3rd January, 2022 passed in Criminal Application No.3175 of 2021 has

granted regular bail to the co-accused persons who are similarly placed.

Apart from above, it is noticed that though the clothes of the applicant were seized in the commission of offence, same are not carrying any blood stains. The statement of witness Sunil Kharat does not disclose identity of the applicant. As far as statement of the complainant is concerned, he has named the applicant on the basis of suspicion.

As such, case for grant of bail on parity is made out. 6.

Applicant is directed to be released on bail on furnishing PR bond of Rs.25,000/- with one or more sureties in the like amount.

Applicant shall not enter the jurisdiction of Jath Police Station till the conclusion of the trial.

8.

Applicant shall attend the Vishrambaug Police Station, Sangli on the first Saturday of every month between 10.00 a.m. to 11.00 a.m. till the conclusion of the trial.

Applicant shall inform his latest place of residence and mobile contact number immediately after being released and/or change of residence or mobile details, if any, from time to time to

the Court seized of the matter and to the Investigating officer of the concerned Police Station.

Applicant to cooperate with the conduct of trial and attend the trial Court on all dates, unless exempted. 11.

Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

12.

If there is breach of any of the aforesaid conditions, the prosecution shall be at liberty to seek cancellation of the applicant's bail.

13.

The application as such stands disposed of.
