Heard learned Counsel for the applicant and learned APP for State.

The applicant is seeking release on bail in Crime No. 479 of 2018 registered with M.I.D.C. Police Station for the offences punishable under Sections 489B and 489C read with Section 34 of the Indian Penal Code.

On the secret information received by the Informant (Police Inspector), a trap was laid and in the course of it, 18 counterfeit currency notes of Rs.2,000/- denomination were found on the person of the applicant. In view of this, the offence aforesaid was registered against the applicant and his companion, Saddam. It also appears, 30 counterfeit currency notes were recovered from Saddam. The learned Counsel for the applicant relies on the statement of one, Jeetin Menon. He submits that, Jeetin Menon does not indicate or even suggest that counterfeit notes were found on the present applicant.

There is no reason to disbelieve the statement of the complainant, who then apprehended the applicant and his associate, Saddam on secret information and found in possession of the counterfeit currency notes.
