Though, the respondents are duly served, no one appeared on behalf of them when the matter called out.
This Application is preferred by the claimants for condonation of 162 days delay in preferring the appeal challenging the judgment and award dated 25.11.2013 passed by M.A.C.T. at Jaysingpur in M.A.C.P. No. 39 of 2009.
Considering the submissions made by the learned counsel for the applicant and averments made in Civil Application, I am satisfied that applicant has made out case for allowing the Civil Application.

i) Civil Application is allowed in terms of prayer clause (a) which reads thus:
"a) be pleased to condone the delay of 162 days for filing the present Appeal and allowed to the Applicant-Appellant to entertain the present Appeal before this Hon'ble Court."
ii) Civil application stands disposed off accordingly.
