Inasmuch as the Petitioner has already filed Appeal dated 26 August 2021 under section 8(3) of the Bombay Nursing Home Registration Act, 1949 before the State Government and he has filed an Application for stay of the impugned order, we are not inclined to entertain the Petition. Having regard to the facts and circumstances of the case and particularly since the hospital in question has been sealed (though illegally according to the Petitioner), we dispose of the Petition by directing the Respondent No.1-Minister, Public Health Department, State of 1/2
k 2/2 4 wp 6600.21 as.doc Maharashtra, to decide the Appeal expeditiously and preferably within two weeks from today.
In the event the Appeal cannot be decided by the Respondent No.1Minster, within two weeks, the Respondent No.1-Minister shall decide the Application for stay within the aforementioned period. The Petition is disposed of in the aforesaid terms. We made it clear that we have not gone into the merits of the matter. All contentions are kept open.
