Heard the learned counsel for the parties.

By this petition under Article 227 of the Constitution of India the Petitioner is challenging the order dated 8.8.2016 passed by learned Additional Collector, Satara under section 14B(1) of the Maharashtra Village Panchayats Act, 1959 holding disqualification of the petitioner for five years for contesting election of Panchayat Samiti. After arguing for some time, the learned counsel for the petitioner submits that petitioner may be allowed to withdraw the present petition with liberty to file appropriate proceeding as per section 14B(2) of the said Act. To that effect, he has given in writing on farad. Same is taken on Mohite 1/2

902 wp9697-16 record and marked 'X' for identification. Same is accepted. Hence, following order is passed:

a) Petition stands dismissed as withdrawn with liberty as prayed.

b) All contentions of both the parties are kept open.

c) If appropriate application/appeal is filed by the petitioner as per section 14B(2) before the Competent Authority, Competent Authority to decide the same as early as possible considering the urgency in the matter.
