This is an Application for re-calling the Order dated 25.09.2017 and to allow the Applicant to comply with the earlier Order dated 05.04.2017 passed by this Court.

Heard the learned counsel for the Applicants, the learned counsel for the intervenor and the learned APP for the Respondent - State.

The learned counsel for the Applicants submitted that due to financial difficulty, the Applicants could not comply with the order dated 05.04.2017 in its proper spirit and could deposit an amount of

APPP 959-17.doc Rs.2,90,000/- only in the Registry of this Court on 06.06.2017. She further submitted that the Applicants have already taken out a Demand Draft of Rs.7,10,000/- and the same will be deposited immediately in the Registry of this Court and therefore, the Order dated 25.09.2017 may be re-called.

In view of the submissions made by the learned counsel for the Applicants and the reasons mentioned in the Application, the Application is allowed in terms of prayer clauses (A) and (B). 5.

All the concerned to act on the authenticated copy of this order.
