One Mr. Manish Kumar had filed a writ petition before the Supreme Court seeking directions to ensure that posts of police personnel in all States and Union Territories are filled up. 2.

After grappling with the issue raised, after six years on 11th March, 2019, the Supreme Court disposed of the Writ Petition and all pending applications directing that its order be communicated to each High Court by the Registry of the Supreme Court requiring the Chief Justice of the High Courts to register Suo Motu Public

2/3 14-SMPIL2.19.doc Interest Litigation and ensure that the posts in the police department are filled up.

On 5th August, 2019, in aforenoted Suo Motu Public Interest Litigation, we had called upon the State of Maharashtra to file an Affidavit disclosing the number of posts lying vacant in the police department with further information as to the stage of the process to fill up the vacant posts.

An Affidavit has been filed informing that from the lowest rung i.e. the post of constable till the highest rung i.e. the Director General of Police, out of 2,19,268 posts, 2,07,725 posts have been filled up leaving 11,543 vacant posts. Meaning thereby, vacant posts are only 5% of the total workforce.

Out of the said 11,543, the bulk vacancies being 1955 in the post of Police Sub-Inspector and 8757 for the post of Constable, Police Naik, Head Constable and Assistant Police Sub Inspector. 6.

Pertaining to 1955 posts of Sub-Inspector, 750 have been recruited and are under training at the Maharashtra Police Academy, Nashik. The training commenced on 22nd October, 2018. Another 650 directly recruited candidates would soon be joining because the Police Sub-Inspector Examination-2017 is underway. This would lead to 883 posts of directly recruited

3/3 14-SMPIL2.19.doc Police Sub Inspectors to be recruited and for which the Maharashtra Public Service Commission has been notified to initiate the process.

Suffice it to state that 100% posts in no Department can ever be filled up for the reason retirement, resignation or death would cause vacancies and time would be consumed to fill up the said vacancies.

Thus nothing remains to be monitored by this Court in the Public Interest Litigation. We are satisfied with the response received and while closing further proceedings would request the Director General of Police in charge of recruitments to ensure that the 8757 posts of Constable, Police Naik, Head Constable and Assistant Police Sub-Inspector are also filled up as expeditiously as possible.

The Public Interest Litigation is disposed of in the aforestated terms.
