The grievance of 78 years old complainant is that trial in a case, registered in the year 1999, is not coming to an end since I.O. is not appearing. 2.

Our attention is drawn to various orders, particularly order dated 1.7.2019, to show that the bailable warrant was ordered against the I.O. Learned counsel appearing for the Petitioner submits that since 24th September, 2018 matter has not progressed. 3.

Learned APP is seeking time to ascertain the facts. He also states that learned trial court can always 1 / 2

In this situation, without observing anything on merits, we direct the respondent to see that concerned I.O. is made available to the trial court, viz. 65th Metropolitan Magistrate Court at Andheri, on the next date of hearing.
