By this petition, the Petitioner is seeking transfer of investigation in FIR No.35/2013 which is with regard to the offence punishable under sections 3(i)(v), 3(i)(xv) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 to State CID or to any lady police officer.

Mrs. Kantharia, learned APP for the State tendered a copy of the letter dated 6th April addressed to her by the Commissioner of Police, Mumbai. The letter discloses that there is only one lady ACP-Ms. Kala P. Gavit who is due for retirement on 30th April 2015. Mrs. Kantharia, in terms of the said letter patilsr 1 / 2
submitted that in this fact situation, investigation may be transferred to Mr. Sudhakar B. Pujari, ACP of Borivali Division and Mr. Balsing K. Rajput, DCP of Zone XI will supervise the investigation. Learned Counsel appearing for the Petitioner submitted that this course of action is acceptable to the Petitioner.

In view of the above, investigation of FIR No.35/2013 is transferred to Mr. Sudhakar B. Pujari, ACP of Borivali Division and Mr. Rajput, DCP shall supervise the investigation. 4.
Writ petition is disposed of with the aforesaid direction.
