This is the second bail application preferred by the same Applicant. On the earlier occasion, he had preferred Bail Application No.775 of 2021. The said application was disposed of vide order dated 16/03/2021. At that time, the matter was fully argued and I had expressed my disinclination to grant relief and the Applicant had prayed for unconditional withdrawal of Digitally signed by MANUSHREE V NESARIKAR Date:

2021.12.21 17:49:51 +0530 MANUSHREE V NESARIKAR the application. I had also expedited the trial. 2.

In spite of that order and unconditional withdrawal, Nesarikar

2 / 2 08-BA-3544-21.odt this fresh application is preferred without there being any change in circumstance, on the ground that the trial could not be proceeded.

It is common knowledge that since March 2021, the second wave of Covid-2019 pandemic was spread all over and therefore functioning of the Courts was badly affected. Therefore I do not find change in circumstance. When I expressed my disinclination to grant relief, the learned counsel for the Applicant prays for unconditional withdrawal of this application as well.

Permission granted. Application is allowed to be withdrawn unconditionally and is disposed of as such. (SARANG V. KOTWAL, J.)
