The learned counsel for the appellant submits that First Appeal preferred by them is already dismissed. Hence, they have no objection if the applicant is permitted to withdraw the amount deposited by them.
Considering the averments made in the Civil Application and as advocate for Insuarnce Company has no objection to allow the present Civil Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:
A) Civil Application is allowed in terms of prayer Mohite 1/2

"(a) The amount deposited by the appellant Insurance Company of Rs.6,64,610/- with Commissioner Workmen Compensation, Thane, At Thane, may be released and given to these applicants."
B) Applicant is entitled to withdraw the amount with accrued interest if any,.
C) Civil application stands disposed off accordingly.
