In pursuance of the order dated 6.9.2016 the Commissioner of Police Thane has issued instructions by its communication dated 13.9.2016 and has directed the Investigation Officer to carry out the investigation in view of the same. The learned APP. on instructions from the Investigating officer who is personally present in Court submitted that the Investigation Officer is likely to submit the final report/charge sheet before the Court of competent jurisdiction within a period of 3 days from today. In view of the above, the learned counsel for the applicant seeks leave to withdraw the present application with liberty to file a fresh application for bail before the Trial Court, if so advised.

Leave and liberty granted.
