This petition filed under Article 227 of the Constitution of India challenge the order passed by the learned Arbitrator on the application of the petitioner for impleading himself as a party to the arbitral proceedings. Admittedly, the petitioner is not a party to the arbitration agreement. The learned Arbitrator dismissed the application by taking note of the fact and observing that a third party to the arbitration agreement cannot be allowed to agitate his rights in the arbitration proceedings. There is no infirmity whatsoever with the view taken by the learned Arbitrator. The petition is therefore dismissed.
