Learned Counsel for the petitioners submit that by this Writ petition under Article 227 of the Constitution of India petitioners are challenging the concurrent finding of fact recorded by both the Courts below allowing plaintiff's application for injunction. He submits that today only he received instructions from his client that Regular Civil Suit No.98 of 2008 is listed for judgment in this month.

In view of subsequent development nothing survives in the present writ petition. Hence, writ petition stands dismissed as infructuous.
