Heard the learned counsel representing the Petitioner and the learned counsel representing the Respondent - the Maharashtra State Electricity Distribution Company Limited ("MSEDCL").

After arguing the Petition at some length, the learned counsel representing the Petitioner, on the basis of the instructions of the Petitioner, states that the Petitioner may be permitted to withdraw the Writ Petition with liberty to invoke LGC

2 (2) wp-9526.23.doc Disputes Resolution Mechanism as given in Clause 18 of the Terms and Conditions of Tender and Contract.

The Petitioner is thus permitted to withdraw the Writ Petition with the aforesaid liberty.

All contentions raised in this Writ Petition are kept open.
