By this Application, the Applicant has sought return of documents mentioned in paragraph 5 of the operative part of the judgment and order dated 15/10/2007.

Mr. H.S. Venegaonkar, learned counsel for Respondent - CBI has no objection for return of documents subject to the condition that the documents will be produced before the Court as and when required. Hence, the Interim Application is allowed in terms of prayer clause (a). 1/2

IA2448.2021.doc The following documents viz. i) Document dated 15.9.96 of Room No.13/B, Ashtabhuja Gorai - Exh.72 ; ii) Sale Deed of Room No.280, Bldg.No.10 - Exh.44 ; iii) Agreement for Sale dated 29th January, 1997 of the property at Hanimnal - Exh.50 referred to in paragraph 5 of the judgment and order dated 15/10/2007, are ordered to be returned pending hearing of the Appeal.

The Applicant to file copies of the documents before the Registry within a period of one week from receipt of the documents. The Applicant shall also produce the original documents, if required by the Court.
