Heard. Petition is filed seeking direction to Respondent No.5 to carry out investigation into the subject FIR. 2.

Initially Karjat Police Station registered accidental death report on account of death of Petitioner's husband. On the complaint made by the Petitioner, FIR came to be registered for the offence punishable under section 302 of the Indian Penal Code, 1860 and for other offences.

Learned APP placed on record report dated 14th March 2017 and submitted that the said CR was investigated and on 14th March 2016 C-summary report was filed before the JMFC Karjat.

In above circumstances, the Petitioner is always at liberty to contest the said report before the JMFC. In that view of the matter, we are not inclined to entertain this petition and the patilsr 1 / 2

same is accordingly dismissed.

the learned JMFC shall give copy of the C-Summary report to the Petitioner and shall dispose of the same only after hearing the Petitioner.
