The learned AGP for the State raised an objection that the PetitionerInstitute is situated at Nanded, the matter ought not to be fled before this Court. According to the learned Counsel for the Petitioners, the authority is situated at Nasik.

In fact the appropriate Court where the present writ petition ought to have been fled, is the Aurangabad Bench. The afdavit-in-reply is fled by the Respondents-State. As per the said afdavit, the further inspection has to be conducted. The decision is taken to reimburse 10% of the amount immediately in favour of the school society. The afdavit-in-reply further R.V. Patil

58 WP.7105.2021 AS.doc states that the decision has been taken to constitute the committee. The amount has been sanctioned by the State Government for reimbursement of fees to the students, who are given admission in a nominated school. 3.

The Committee is required to conduct the inquiry of various schools and the report is required to be submitted to the concerned department of the State Government.

The matter would not be in respect of the Petitioner - Institution individually, but all the similarly situated institutions throughout the State. The Respondent-State may proceed with the process as is detailed in their afdavit epÝpeditiously.

It is further submitted that Government Resolution dated 29th March 2022 is also issued, wherein the decision is taken to disburse 25% amount.
