This MCA seeks transfer of a matrimonial proceeding for dissolution of marriage pending before the Family Court at Pune to the Family Court at Solapur.The Applicant's petition for restitution of conjugal rights is pending before the court of Family Judge at Solapur. On the last two occasions when the matter was called out, i.e. on 5 October 2016 and 18 October 2016, none appeared for the Applicant. In fact, by an order dated 18 October 2016, this Court directed that the matter be placed for dismissal on the next date. The ad-interim order was continued only upto the next date, i.e. on 24 October 2016. Even today, none appears for the Applicant.

The MCA is, accordingly, dismissed for want of prosecution. (S.C. GUPTE, J.) 1 / 1
