DATED : 3rd OCTOBER, 2022 P.C:- The applicant came to be arrested on 29/12/2022 in connection with MECR no.1/2018 registered with Versova police station which invoke Section 420, 465, 467, 468, 471 and 120 B of the IPC.

The complaint came to be filed at the instance of one Dinya Vaiti, who stated that the Machimar Samaj, Versova was allotted a plot for construction of residential units and from common contribution, and construction was made on the allotted plot and the father the deceased was also allotted a residential unit bearing C-304. He was repeatedly making correspondence

2/3 24 BA 3616-21.doc with the Samaj, to put him in possession and even he made application before the Deputy Registrar of Society, seeking transfer of the shares in the name of his father in his own name. At this stage, it was realized by him, that the present applicant for valuable consideration of Rs.33,50,000/- had transferred the premises to one Manoj Gada and a picture was created that the Power of Attorney is given by the present applicant to him. The photograph of the complainant was affixed and a registered sale deed was executed by impersonating him. This resulted in the C.R being registered and the material to that effect is already compiled in the charge-sheet. On the last date, the learned APP had made a categorical statement that the applicant is involved in similar such allegations and four C.

Rs are registered against him with the very same police stations, where he is accused of similar conduct. Copies of the FIR and the statement of the complainant on whose behalf the complaints were lodged and C.Rs were registered are placed on record. This include C.R.Nos. 214/2018, 447/2017, 423/2010 and C.R.No. 431/2018. All the aforesaid C.Rs invoke offences of Section 420 and when the complaints are carefully read, it refer to a similar accusation, which are faced by the applicant in present CR.

3/3 24 BA 3616-21.doc Considering the expertise of the applicant in preparing such documents fraudulently, and putting it to use, the applicant do not deserve his release on bail. Application is therefore, rejected.
