The learned counsel appearing for the second respondent on instructions states that the impugned communication dated 1st July 2017 stands withdrawn. He submits that a liberty may be reserved to enable the Municipal Corporation to initiate appropriate action in accordance with law against the petitioner. We accept the aforesaid statement. Hence, nothing survives in this petition and the same is disposed of.

wp9179 We make it clear that withdrawal of the communication dated 1st July 2017 will not prevent the Mumbai Municipal Corporation as well as third respondent from initiating appropriate proceedings against the petitioner. In view of withdrawal of the communication dated 1st July 2017, even the letter dated 21st December 2016 (Exhibit-H to the petition) is rendered in-operative.
