It appears that, despite directions issued on 29 th July, 2019 the Legal Aid Committee has not appointed Panel Advocate for the petitioner.

Learned APP has pointed out that appraisal

Rane 2/2 WP-3773-2019 (SR.17) 24.9.2019 report of petitioner under Section 432(2) of Criminal Procedure Code has been requested from the City Sessions Court, Mumbai which has convicted him in Sessions Case No. 434 of 2003 on 22nd April, 2004. That report is still awaited.

In this situation, we direct the convicting Court to expedite action and to submit suitable report to Superintendent, Nashik Central Jail within four weeks after receipt of this order by it.

After receipt of said appraisal report, the Competent Authority i.e. State of Maharashtra shall take further decision within next ten weeks. 6.

With these directions, we dispose off Writ Petition.
