This is an Application for anticipatory bail in Anticipatory Bail Application Nos.1409 of 2017 and 1453 of 2017.

Both Applications are filed for grant of anticipatory bail in C.R.No.131 of 2017 registered in Mhasrul Police Station District Nasik for the offences punishable under sections 354, 394,452,427 of the IPC.

Both sides are heard. Papers of investigation are made available for the perusal of the Court.

The First Informant and the Applicant hail from the same place. The incident in question took place on 22.2.2017 at 7.15 p.m. and the incident started on a petty quarrel. Allegations are made that the present Applicant went towards the shop of the First Informant and during the incident, the Applicant-Vasant Balkrishna Dhatrak collected the cash amount of Rs.15,000/- which was present in the cash box of the grocery shop of the First Informant. Some allegations are made that a lady member was man-handled and thereby an offence under section 354 of the IPC was committed by the present ApplicantVasant.

Considering the age of the Applicant-Vasant Balkrishna Dhatrak who is aged 66 years, the reason that the incident took place on a petty quarrel, both the Applications needs to be allowed subject to the condition of depositing Rs.15,000/- in the crime or before the police by the ApplicantVasant Balkrishna Dhatrak during the interrogation which he has to face.

In the result, both Applications are allowed in the aforesaid C.R.

Interim relief granted earlier is confirmed subject to the condition that the Applicant-Vasant Balkrishna is to deposit Rs.15,000/- before the police and that amount is to be treated as the property recovered in the present matter. They are to attend concerned police station on every Sunday for one month between 9 A.M. and 12 Noon and they are to co-operate police during investigation.
