Heard Mr. Pramod Kathane, learned Advocate appointed under the legal aid scheme for the Applicant and Mrs. Deshmukh, learned APP for the Respondent-State.

The Applicant, who is in jail seeks condonation of delay in instituting the Appeal against his conviction. Though the delay is of 297 days, sufficient cause has been shown in paragraphs 3 to 8 of the Interim Application.

Therefore, considering the same, the delay is condoned. 4.

Interim Application is disposed of.

Today, by separate order we have condoned the delay in

Shiv 4.ia2839.22.doc instituting this Appeal. Therefore, by consent of learned Counsel for the parties we have take up the Appeal for consideration and Admit the same.
