IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 842 OF 1998 Mahanagar Telephone Nigam Limited ... Petitioner v/s Shri Chandrakant Ranoji Tate & anr.
... Respondents None present for both parties.
CORAM: N.M. JAMDAR, J.
DATED : 10 SEPTEMBER 2015 P.C.:
The petition was admitted on 16 March 1998 and the impugned order passed on 15 September 1997 was stayed. Thereafter the Petitioner has deposited certain amount pursuant to an order passed in civil application filed under Section 17-B of the Industrial Disputes Act. It appears that the amounts have been withdrawn by the Respondent No.1. Thereafter, whenever the matter has appeared on board, either petitioner or the respondents have remained absent. By an order dated 15 April 2010, the Court has noted that the Respondent who was working as a casual labourer, was out of service since March 1997. The matter was dismissed for default on 1 July 2010 and then restored. Thereafter also the same has not been diligently prosecuted. Complete copy of the petition is also not on record, perhaps not reconstructed after
bsb 2 213.WP842.98.doc the dismissal. It appears that both parties are not interested in getting this petition decided.
The writ petition is dismissed for want of prosecution. ( N. M. JAMDAR, J. ) CERTIFICATE Certified to be true and correct copy of the original signed order.
