Heard the learned Counsel for the applicant and the learned APP.

This is an application seeking relief of relaxation of condition to attend Sessions Court, Kalyan during pendency of the appeal. Learned Counsel for the applicant had stated that the applicant was rather attending the Court of Sessions of Kalyan. However, his attendance was not being recorded, since there was no register to mark his presence. This Court had therefore, requested Talwalkar

1.IA2446.2021.doc Registrar (Judicial I) to verify the same vide order dated 9/2/2022. The District Judge-1 and Additional Sessions Judge, Kalyan by communication dated 10/2/2022 has communicated that the Court in which the accused was directed to give attendance has been disbanded and therefore, the register pertaining to that court is now maintained with the Court of District Judge- 1 and Additional Sessions Judge, Kalyan being principal court since 16/11/2019. In view of this, the applicant shall mark his presence before the Court of District Judge-1 and Additional Sessions Judge, Kalyan once in 6 months during pendency of the appeal. With this direction, Interim Application stands disposed of.
