The Petition has been filed challenging the order dated 29th March, 2022 passed by the District Judge, Pune in an Application filed by the Petitioner seeking modification of the status quo order dated 29th October, 2021 which came to be rejected by the District Judge. 2.

This Court is informed that the Appeal is listed for final hearing on 23rd November, 2023. Considering that the order of status quo was an interim order operating during the pendency of the Appeal and the Appeal is now listed for final hearing, in the interest of justice the District Court, Pune can be requested to decide the Appeal.

Learned counsel for the parties submit that on 23rd November, 2023 the parties will proceed with final arguments. 4.

The District Court, Pune is requested to decide the Appeal expeditiously and in any event on or before 30th December, 2023. Learned counsel for the parties submit that no adjournment will be sought and that they will proceed with the hearing in Appeal. These submissions are accepted as an undertaking given to this Court. 5.

Writ Petition is disposed of in the above terms. 6.

It is made clear that this Court is not gone into the merits of the case.
