Heard learned Counsel for the petitioners and learned counsel for the respondent no.1.

Respondent No.1 - Dr.Vijay Arihant Sangave (original complainant) is present in person.

Learned Counsel for the Respondent No.1 has tendered an
2/3 affidavit dated 26th October, 2016, filed by Respondent No.1 - Dr.Vijay Arihant Sangave (original complainant). The said affidavit is taken on record and marked 'X' for identification.

Respondent No.1 has stated in the affidavit that he has amicably settled the dispute with the petitioners and that he has received a sum of Rs.60,000/- by way of full and final settlement. Respondent No. 1 has further stated that as he has received the aforesaid amount of Rs.60,000/-, he has no grievance against the petitioners. He has further undertaken to withdraw the criminal complaint being Criminal Case No.1134 of 2015, which is pending before the learned Judicial Magistrate First Class, Court No.1, Ichalkaranji, Kolhapur, within three weeks from today.

Respondent No.1 to abide by the undertaking given by him in the affidavit. He shall withdraw the criminal complaint being Criminal Case No.1134 of 2015, which is pending before the learned Judicial Magistrate First Class, Court No.1, Ichalkaranji, Kolhapur, within three weeks from today, in view of the settlement between him and the petitioners, and as he
3/3 has received an amount of Rs.60,000/- from the petitioners, by way of full and final settlement.

In view of the undertaking given by the Respondent No.1, learned counsel for the petitioners does not press this petition and seeks leave to withdraw the same.

Accordingly, the petition is disposed of as withdrawn. 8.
