P.C.:- This Petition is for issuing direction to the Trial Court to decide the Miscellaneous Application No. 330 of 2017 in Special NDPS Case No. 48 of 2017, within stipulated period. Heard Mr. Inamdar, the learned counsel for the Applicant, Mr. Saldhana, the learned special PP for the Respondent No.2 and the learned APP for Respondent No.1-State.

It is the grievance of the Petitioner that, the said Miscellaneous Application No. 330 of 2017 for return of property is pending for adjudication for last more than one year on the file of the learned Trial Court and as the property (Vehicle) may get rusted 1/2

ssm 2 905-wp3321.18.doc and/or its condition may get deteriorated, it is desirable to decide the Application at the earliest.

Mr. Saldhana, the learned Special P.P. fairly submitted that appropriate Orders in the interest of justice may be passed. In view of the above and for the reasons mentioned in the Application, the learned Additional Sessions Judge, 5th District Judge, Thane, seized of Miscellaneous Application No. 330 of 2017 in Special NDPS Case No. 48 of 2017 is hereby directed to hear and dispose of the said Application within a period of three months from today.
