Heard Shri K.M.Mhatre, the learned counsel for the applicant. Heard Smt.M.R.Tidke, the learned APP for the State. The learned APP prays for time on the ground that she has not received instructions from the Investigating Officer. She, however, avk 1/3
states that intimation of the present application was given to the Investigating Officer. Under these circumstances, I am not inclined to adjourn the matter any further.
Though the applicant was ordered to be released on bail on certain conditions by the order dated 15th July 2014, the applicant was not actually released from custody. It is because of the pendency of some other cases against him, in which also he was in custody. It seems that the applicant has now secured bail in all the cases pending against him. In these cases, some conditions requiring him to attend the office of the DCB CID, Unit No.I, have been imposed. It is, therefore, submitted that, the condition imposed by this court by its order dated 15th July 2014, requiring the applicant to attend the concerned Police station on every Monday, Wednesday and Friday, be cancelled or modified. I have considered the matter. The condition was imposed one year back. The applicant has remained in custody inspite of the bail order. That condition is not very relevant now, avk 2/3
in view of the fact that the applicant shall now be attending the trial court, and further that, he will be attending the office of the DCB CID, as per the conditions imposed by the Special court under the MCOC Act. Under the circumstance, I am inclined to modify the condition.
The condition requiring the applicant to attend the concerned Police station thrice a week is cancelled by stipulating that the applicant shall report to the concerned Police Station on the first Monday of every calendar month till the disposal of the case against him.
The application is disposed of accordingly.
