Heard Mr. Mishra, learned Counsel for the petitioner and Mr. Khan, learned Counsel for the respondents.

This Petition is filed under section 114 r/w Order-XLVII, Rule-1 of the Code of Civil Procedure, 1908 (for short 'C.P.C') seeking review of the order dated 2nd July, 2018. By that order, the Petition instituted by the petitioner was allowed and compensation of Rs.49,396/- per month was reduced to Rs. 25,000/- per month.

After arguing the Petition for quite some time, Mr. Mishra seeks permission to withdraw the Petition. Mr. Khan has no objection.

Review Petition is dismissed as withdrawn.

At this stage, Mr. Mishra submits that time stipulated in the order dated 2nd July, 2018 for depositing 50% of arrears of compensation for the period from 17th February, 2017 to 31st July, 2018 within six weeks from today. He further assures that the petitioner will not seek further extension of time for depositing arrears of compensation. Assurance given by Mr. Mishra is recorded. 7.
In view thereof, petitioner shall deposit arrears of compensation for the period from 17th February, 2017 till 31st July, 2018 within six weeks from today, failing which the order impugned in the Writ Petition stands revived without further reference of the Court. 8.
Liberty to the parties to file application before the Appellate Court to decide the appeal in a time bound manner. If such application is made, the Appellate Court will pass appropriate order in that regard. [R.G. KETKAR, J.]
