Learned Advocate for Respondent No.2 has raised a 1/3

preliminary objection that the Petitioner has a remedy of appeal before the President of Respondent No.2.

The learned Counsel for Respondent No.2, on written instructions, submits that a statement was made that the results of the election would not be declared till the next date. According to him, in view of the said statement, the results of the election are not declared. He further makes a statement on the written communication issued to him that Respondent No.2 would maintain the said statement made, till disposal of the appeal and for a period of 10 days thereafter. The said statement is accepted. The Petitioner shall file an appeal within 10 days from today. If such an appeal is filed, then the Appellate Authority shall endeavour to decide it expeditiously, preferably within 30 days from the date of filing.

If the appeal is not filed by the Petitioner within 10 days, then the statement of Respondent No.2 shall not continue. If the appeal is filed within 10 days, then the statement made that the results shall not be declared till the appeal is decided and for 10 days thereafter, shall continue.

The Writ Petition is disposed of. No costs.

In view of the statement made by Respondent No.2 in the Writ Petition that the results are not declared the Contempt Petition also stands disposed of.
