1) Heard the learned counsel for the applicants. It appears that applicant was arrested on 06/02/2009 in crime no. 5 of 2009. He was enlarged on bail by the Trial Court on 21/02/2009 on a condition that he shall co-operate with the investigating and remain present before the court at the time of framing of charge. Case is of the year 2009. Applicant had not abided by the conditions imposed upon him and therefore non-bailable warrant was issued against the present applicant. Applicant did not appear before the court. Non-bailable warrant had been issued against the applicant in 2011. Matter was adjourned on 42 occasions due to the absence of the applicant. 2 11.1697.16 ba subsequently appeared before the court on 12/07/2016 seeking relief of cancellation of non-bailable warrant.

2) The learned APP submits that in all probabilities charge is framed against present applicant. It is in these circumstances that applicant does not deserve to be enlarged on bail. Application stands rejected. However, learned Sessions Court is requested to make an endeavour to conclude the recording of evidence as far as possible within 4 months from the date of framing of charge.
