Order dated 28/04/2017 reads thus :- " All office objections to be removed within a period of 8 weeks from today i.e. 21 July, 2017 failing which the Applications will stand dismissed without further reference to the Court. "

By order dated 22/02/2018, the applicant was directed to ensure that the service is completed upon the respondents and it was made clear that no further adjournments will be granted on the ground of settlement talks. On 19/11/2018, the matter was once again adjourned 1/2

P.H. Jayani 38 CAS672.17.doc at the request of learned counsel for the applicant. On 26/11/2018, it was observed that despite order dated 22/02/2018, the appellant has not taken any steps to complete the service of notice and the matter was adjourned by way of final opportunity.

Despite several opportunities given, the applicant has neither complied with the order dated 28/04/2017, nor given any satisfactory explanation for non compliance of the order dated 28/04/2017. Hence, in terms of the said order, the Application stands dismissed. 4.

Civil Application No.1822 of 2016 stands disposed of in view of dismissal of the Civil Application No.672 of 2017. (SMT. ANUJA PRABHUDESSAI, J.) 2/2
