Learned APP, on instructions, submitted that the charge is already framed against the applicant. However, the accused is not cooperating in the proceedings with the trial. Next date before the trial Court is 7th February, 2019. It is submitted that the prosecution would adduce evidence of the complainant, victim and other witnesses, expeditiously. In view of the aforesaid submissions, learned counsel for the applicant seeks permission to withdraw this application. Hence, application is allowed to be withdrawn. Considering the submissions advanced by the learned APP, trial Court shall make an endeavour to dispose of the case expeditiously. The defence is also expected to cooperate with the trial.
